From January the 1st 2004, underground, private, in individual or collective using swimming pools must have a security system to anticipate the drownng risk in accordance with the law N°2003-9 of January the 3rd 2003.

In France, the drowning is the first reason of mortality in accidents in the home for children under 5 years. A lapse of concentration, the children unpredictable behaviour, or the inadequate protection of the pool and it's enough !

- If the pool was built earlier than the 1/1/2004, the security system must be installed before the 1/1/2006, except collective using pools (camping, hotel…) and real estate in location (yearly or seasonal) for wich the upgrade dead line is the 5/1/2004.
- In case of pool under construction, the security system must be installed at the moment of the construction from the 1/1/2004.

The no respect of the law n°2003-9 of January the 3rd 2003 is punished by a 45000 euros fine and above all, the responsability of the pool owner or administrator could be implicated.
